DOLE Bicol calls private employers to voluntarily regularize workers in Bicol


 

Legazpi City – “We are NOT trigger-happy in declaring labor only contracting (LOC).”

This was the statement of Atty. Alvin M. Villamor, regional director of Department of Labor and Employment (DOLE) RO 5 yesterday as the agency continuously advocates voluntary regularization of employees working in the private sector in Bicol Regison.

He added that within a period of 10 days from the issuance of Notice of Results (NR), any establishment is given opportunity to rectify or restitute findings based on NR.

“They have to welcome it as a chance and capitalize on it to regularize workers,” Villamor stressed.

To curb “ENDO” and “contractualization”, an extensive campaign intended to encourage private establishments to implement voluntary regularization scheme in the region has been vigorously conducted by the DOLE RO 5.

“We want to stop the practice of illegal contractualization by means of promoting voluntary regularization of workers in Bicol as our developmental approach/ strategy that we employ in the region in response to government’s call to end contractualization,” he continued.

“I just rode and improved it. This is DOLE RO 5 accomplishment,” said RD Villamor who just assumed post last August 13, 2018.

A series of labor management forum has been conducted in the region and the latest was in Sorsogon last September 12, 2018. Same activity shall be conducted in Camarines Sur and Camarines Norte in the second and third week of October, respectively.

This labor management forum aims to orient private employers and workers of the new minimum wage, Wage Order No. RBV, department orders of DOLE, Occupational Safety and Health Standards (OSHS) Law, which mandates strict compliance of employers to workplace safety standards, Employees’ Compensation Commission (ECC) programs and the Voluntary Regularization Program.

Number of regularized workers

A total of 11,800 workers gained regular employment from their companies here in Bicol from January to September 2018.

Of this number, 6,467 of them were regularized through inspections conducted by the Labor department. On the other hand, 5,333 were regularized voluntarily by their respective employers.

Further, the Labor Department in Bicol recorded 326 establishments in all provinces of Bicol that regularized their workers from January to September 2018. At least 226 companies regularized their own workers upon visit by the agency’s inspectors, while 100 establishments voluntarily regularized their own workers

According to DOLE, labor-only contracting exists when the contractor merely recruits, supplies, or places workers to perform a job or work for a principal under any of the following circumstances: the contractor does not have substantial capital, investments in the form of tools, equipment, machineries, supervision, work premises, among others, and the contractors employees recruited and placed are performing activities which are directly related to the main business operation of the principal; or the contractor does not exercise the right to control over the performance of the work of the employee.

Meanwhile, RD Villamor said that during the conduct SEnA (Single Entry Approach), “we try to convince also the principals/ employers to regularize workers in their respective establishments who responded in positive way embracing the advantages of voluntarily regularizing their workers.”

SEnA is an administrative approach to provide a speedy, impartial, inexpensive, and accessible settlement procedure for all issues/complaints arising from employer-employee relations to prevent them from ripening into full blown disputes. Under this approach, all labor and employment disputes shall undergo a 30-day mandatory conciliation-mediation process to effect settlement among the contending parties.
