Driver gets separation pay and other benefits

Camarines Norte - From sunrise to sundown, Mr. Jerwin Mercado transports and delivers loads of milled rice from the warehouse to retailers and distribution centers in most municipalities in the province. He plans routes and arranges delivery schedules. For 12 years, he faithfully fulfils these tasks until his service has been terminated last August 2022.

During the interview, Mr. Mercado confessed that he had been reprimanded by his employer and got fired without providing him the opportunity to get heard. Still hopeful that his employer might have changed his mind, he pleaded to get him back. Unluckily, his employer has made up his mind not to recall his service.

He could have accepted his plight and may have relieved his employer from any monetary obligations due to him, but he finds no job that will support his family. He and his wife visited and inquired with DOLE about any claims he could have received out of his termination.

Guided by the applicable labor standards, assisting personnel of this Office, facilitated the filing of the request for assistance (RFA) of Mr. Mercado for monetary benefits and scheduled its initial hearing last August 24, 2022.

During the conduct of the initial conference, Hearing Officer, Ms. Renalyn E. Alano, allowed both parties to present their issues and claims and determined whether they are valid and demandable by law.

When validated with the employer whether the two-notice rule has been observed, he admitted that he was not able to provide any memorandum or notice at all to Mr. Mercado of his offenses instead he has ordered his dismissal. Having been resolved before the hearing officer, both parties entered into compromise agreement which forms part of their commitment to settle the RFA filed before this Office.

By the end of the conference, Mr. Mercado acknowledged receipt of the sum of P56,739 as the final computation of the monetary benefits due to Mr. Mercado to include separation pay, last salary and service incentive leave in cash from his employer. As proof of amicable settlement, Mr. Mercado freely and voluntarily executed a quitclaim and release as part of the compromise agreement reached during the conciliation conference.

Mr. Mercado thanked the DOLE for the speedy settlement of his case filed before the Provincial Office. “Nagpapasalamat po ako sa maayos at mabilis na pagsettle ng aking naidulog na reklamo sa tanggapan ng DOLE. Yung inaakala ko pong matagal na proseso ay nagawa po nila sa pinakamabilis na panahon.”

Through the SENA, it only took the DOLE Camarines Norte Provincial Office 7 days to settle his complaint.

PFO Head, Ms. Cherry B. Mosatalla shared that she was happy that DOLE was able to deliver its service effectively and efficiently. “It’s actually a music in our hearts when hearing of their gratefulness of our services provided to them. This gives us the inspiration to strive more in doing our Agency mandated.”
